L1B - I94 expires on Oct 2017 but visa petition expires on August 2016

Hi,

1. L1B visa expires on September 2016 but I-94 expires on Jan 2018.
2. My spouse (L2B )visa expires on September 2016 and also I-94 expires on September 2016.


Question:
1. Can I work after August 2016 with valid I-94 till Jan 2017.

2. Can my wife stays along with me till Jan 2017 even with her expired visa and I-94.

You are not allowed to legally work on an expired petition. You need to file for renewal before the petition expires. Once the renewal application is submitted you can continue working till the time decision is pending.

- No, she need to leave the country before her I94 expires or file for extension/renewal.
