  • Recommended Filing sequence for L2 and L1

    My Wife and I are working in India. I recently got a L1 from my employer. I have not travelled yet. Meanwhile, my wife's employer also planning to file for her L1 to retain her. However she is not from core IT and she might have tough time to secure an L1. At this stage, I have 2 options.

    1. Proceed with her L2 and once her L2 is secured, then ask her employer to file the L1.
    2. The Other way, that is ask her employer to file the L1 first and if outcome is negative then file for her L2.

    To me, #1 seems logical, however, can she loose her L2 as well if her L1 does not gets through?

    Please advice.

    Legally L2 person can work in USA. The safest bet will be to apply for her L2 & than EAD once in USA. This way she can back on her job with her own company after 1-2 months of reaching to USA.

    Later if you guys want, she can convert her L2 to L1 as well.
