  • MPS (Maximum Physical Stay) or I-94

    Hi Everyone,

    I am in an L1B Visa and been here in the US since 2011. My MPS is 5 years and as per my calculation it will be Oct 2016.

    I went back to my home country and have my Visa Renewed last year (2015).

    Now I have an updated documents :

    1. VISA L1B - end date = 09/22/2020
    2. I-129s - end date = 10/20/2018
    3. I-94 - end date = 10/20/2018

    I called the following Government agencies :
    1. USCIS
    2. Department of State
    3. Customs and Border Protection

    My questions to them are :

    1. Should I follow my I-94's end date? or the MPS end date?
    2. Did my MPS got a reset when I renewed my VISA?


    They all said that the same thing. That I should follow my New I-94.
    The CBP officer, while on the call with her even sent me a response on my inquiry on their website with this :

    "Thank you for contacting the U.S. Customs and Border Protection (CBP) INFO Center.
    Your most recent I-94 will tell you when you need to depart the U.S. In your case it will be
    October 20, 2018. When your visa and petition was renewed, so was your stay.
    "

    Though I got an official note from CBP, i am still hesitant on this as all the research I did on the net says otherwise.

    Would you be able to help me with this?
