  • I-94 Extension for my dependent

    Hi,

I am on L1A visa. Currently, my green card process is in progress. (My I-140 yet to be approved. Concurrent process) My son's I-94 expiry is in next year May/2017 but my son's I-94 expiry is in June/2016. Please let me know if I need to go for I-94 ext for my son OR do I need to wait for GC.

    Please help me.

    This is confusing:

My son's I-94 expiry is in next year May/2017 but my son's I-94 expiry is in June/2016.

At any rate, you need to leave the country before your I94 expires or you need to apply for extension before the expiry. GC application is good for you, but not for your son.

      Correction :

My I-94 Expiry next year. My son's I-94 expiry this year.

From your reply I understood that both are not related. GC is related to Immigrant. L2 extension related to Non-Immigrant visa. Since, I didn't get GC yet, I have to go for I-94 ext. for my son since it is expiring in 3 months.

Please confirm if my understanding is correct.
