  • COS (Change of Status) L2 to L1

    Hi,

    My Husband is working in L1-B, Now I have L2 and EAD. I am going to US for work by next month and planning to apply for COS (Change Of Status) (Form I-539) from L1 to L1A. Can you please help with the below clarifications?

    1. After i started working in US (in L2+EAD), when can i start apply for COS? Do i need to wait for any certain days?
    2. If my COS denied, Can i continue with my L2+EAD?
    3. If my COS approved, My husband's L1-B will be cancelled and he cant continue work in his L1-B?
    4. Can i get stamping (L1A) in US itself if my COS approved?
    5. What are the documents need for COS?

    You can apply immediately, however your L1, you need to be working for the same company for 1 year out of last 3 years.

    Yes, if they do not cancel your L2 and/or EAD. If they cancel anything, you will be informed.

    Nope, for stamping you need to go outside USA. But you do not really need stamping till the time you are inside USA

    There are a lot of documentation needed, get in touch with your company's HR or an attorney

        No, it will happen only if they think your COS is fraudulent. Otherwise chances are nil.
