  • L1 Visa can be applied for new job from US company

    I have 5years of experience in software development, I got an offer from US company(new job) they are saying they will apply for L1 visa for me. I never worked in this company previously eventhough i will be qualified for applying L1 visa? i heard that i need to work for atleast 6months in a company to transfer me to US on L1 visa, is there any other visa other than H1B on which i can join in US company directly?

    You have to work for at least 1 Year at their non US branch/subsidiary in order to be eligible for L1.

      L1 is a intra-company transfer, which means you do not change the company, but change the branch/location.

      So you need to be already working (1 year out of last 3 years) with outside-US branch of an MNC to move to USA on L1 visa.

        Hi,

        Which visa they can apply for my case now as already H1B visa time over. I heard there is some EB type visa, my new job in US is permanent job. Am i eligible to apply for any other visa to join my new job directly in US.

          Not many options. EB categories are for permanent employment. EB1 would need you to be an Executive/Managerial, again needing to work for at least 1 Year outside US. EB2/Eb3 can take 8-12 Years if born in India. If you are someone with extra ordinary abilities (international athlete/Nobel prize etc) there could be other options.

            Requirements for EB1C & L1A are almost similar.
