    Hi,

    I was in US with L1B visa from 2010 to 2015 and came back to india in Sep 2015 due to max out. I have an approved I140 with the current company.
    My company is planning to initiate L1B again this year. My questions are:

    1. What is the earliest date for the L1B case to be submitted in USCIS.
    2. Considering the rejection cases on L1B, What are the chances of getting L1B again the second time with approved I140.

    Please advise.

    1. 365 Days from your exit date. After all, you have to provide evidence of being out of US for 365 days, which you can only provide if you are already out for 365 or more days.
    2. Contrary to popular belief, visas are generally not based on ones "chances" . If you have a strong case, you would most likely get it.

      Once i get L1B again this year, can i change Green card category from EB3 to EB1 as i have 11 years experience and i have 8 resources reporting to me. Please advise.

        Did you have a similar reporting matrix when you were outside US working for that employer?

          I did not have any reportees when i was there at US,but i have 8 reportees currently at india.
