  • L1 to H4 and back to L1

    Hello,

    I am on L1 and my spouse is on H1. My employer informed me that my project is going to end and i should travel back to India on 14th of May. so, i decided to quit my company (not communicated to my employer so far) so we started my H4 with my spouse company. they filed my H4 application, in which they requested the COS will be effective from 13th May. But now my employer found another project for me. Now my questions are

    1. Will my L1 be cancelled or will i be able to continue on my current L1 since i am still on my company payrolls.
    2. Do i need to stop H4 processing? if yes, how i can do that?
    3. Is there any other solution to handle this situation.

    Appreciate your expert advise.

    You should have kept the L1 employer in loop and communicated that you would file/have filed a COS to H4. Did you get the receipt?

    If you are sure of the project availability, I would suggest you immediately work with the lawyers in withdrawing the L1 to H4 COS request.
