  • L1B person getting married , How to get L2 and EAD.

    Situation: I am working in NewYork city on L1B individual visa. In July 2016, i will be going to India and getting married to an Indian citizen.

    Questions::

    1) Who will raise my wife's L2 visa? My employer OR myself?

    2) Cost involved?

    3) Which forms required to be filled up. [DS160 or I539 ?? ]

    4) If DS160, can i fill up DS160 before my marriage and submit it ??? And can take interview date after marriage ??

    5) Any problems/Hurdles in getting EAD. whether my employer or myself is sponsoring her visa??

    Please share your thoughts. I am looking for help.

      1. You can do it.
      2. I would say if you do it alone, only the visa cost which I believe is 290 USD.
      3. First time Visa stamping is got through by filling DS-160 online and attending the visa interview and fingerprint scan. An request for extension of stay when in US is applied using form I539 . Do in your case it is going to be DS-160 as your spouse never had visa.
      4. Yes. Yes.
      5. Dont see any issues base don information provided by you.

      This is my opinion not legal advice.

        Be cautious

        Hello!

        Please be cautious i would strongly recommend your wife to go alone to the consulate and get her L2 done. I was on L1 since nov 2012 i came for my wedding back in 2015 feb and went to consulate with my wife for an extension and her L2 but the visa officer cancelled my existing visa i don't know why. I've my stuffs including a car back in America, i don't want anyone to get into my situation please be cautious.

        Thanks!
