  • Apply B2 before L2

    Hi,

    I am on L1-A visa and want to bring my wife (dependent) in USA "urgently". For L2 visa interview the earliest date available is more than 3 months away whereas the B2 (visitor) is available within 10 days.

    I have below questions:
    1) Could she apply for B2 now and visit USA, then go back to India after a few months and apply for L2 then?
    2) What are the chances of B2 approval in this case as she is entitled to L2 logically?
    3) Would B2 rejection impact L2 in future?
    4) If B2 gets approved then can she apply for L2 while she is still in USA (on B2)?

    1. She can, but the question will obviously come that why is she going for B2 when she is eligible for L2. Non availability of visa appointment is not a strong reason.
    2. Pretty low, the officer will most likely say apply in L2.
    3. No.
    4. Possible.

      The only time I've seen 'urgently' in the past is if pregnant and due soon.
