  • L1B Visa Expiry - Need advice

    Hi,

    I need some advice on this.

    My current L1B visa and I-129 is expiring on Dec 2016. What would you advice on below options to go for ?

    1. Apply for L1A conversion (I'm eligible for L1A) - Does L1A have same conditions that I cannot apply for other companies?
    2. Apply L1B Extension and apply H1B in April 2017?
    3. Apply for Green Card from L1B in EB2 category ? Current EB2 approval goes more than 6 yrs I think. If I go for GC, I feel it will be difficult to stay since if I apply for L1B extension which is valid till 2 yrs only. Then I have go out from US. In this case my GC will be disqualified - Is it true?

    I believe your first intent is to continue to stay in US beyond Dec 2016. And that can happen only if you file either L1B extension or conversion to L1A. Now, which of these is a stronger case depends upon the documentation that you, your employer and attorney can provide.

    On both L1A and L1B one cannot change employer unless one gets a GC or moves to H1.

      Thanks. Just have one more question. If I go for L1A and if it gets approved then after how many months/yrs I can apply for GC?

          L1B Visa Expiry - Need advice

          Hi,

          My cases is same as this one except I'm not eligible for L1A. I'm currently on L1B expiring in Dec2017.

          Am I eligible for GC processing ? Also, As GC processing takes longer, what options do I have do I have to extend my staty here ?

            Yes you are eligible. L1 ab can at max be extended for a total stay of 5 years. If you dont get GC till then, you have to move to some other status in order to stay in US, and if you want to work, you would need to move to H1.
