I was in US from Jul-2010 till Mar-2014 and I was holding valid L1-B Blanket Visa (PED=Jul-2015) when I moved out of US in Mar-2014.
Here is the list of events
1. Jul-2010: My First Entry to US with L1-B Individual Visa (PED =Mar-2013).
2. Jan-2013: Got Visa Stamping in Canada for 1 new L1-B Blanket petition(PED=Jul-2015) file by employer and re-entered USA.
3. Dec- 2013: PERM filed by Employer in EB3 category with L1-B Status ( Blanket Petition with PED as Jul-2015)
4. Mar-2014: Traveled to India for personal Reasons and I did not go back to US.
5. Apr-2015: Perm Approved and I-140 was initiated by the Employer while I was in India.
6. Jul-2015: L1-B Blanket Petition(PED = Jul-2015) expired while I was in India.
7. Apr-2015: I-140 approved while I was in India.
8. Dec-2015: My Employer files a new L1-A Individual Petition while I was in India.
9. Jan-2016: L1-A Individual Petition Approved while I was India.
10. Mar-2016: Got L1-A Individual Visa Stamping in India.
11. Nov-2016: Traveling to US.
With these list of incidents, I want to understand
1. I would be entering US with the new L1-A individual visa. Will the approved I-140 be still valid ? Or do I have to initiate a new PERM?
2. If my approved I-140 is valid when I re-enter US by Nov 2016, is there a chance to Upgrade to EB1 preference, since I am holding an L1-A visa now with exceptional skills ?
3. If my approved I-140 becomes invalid, (since I am holding a new L1 A individual Visa) , Do I need to file for a new PERM or Can I apply for a GC under EB-1 ?
Please let me know all the options that I have .
