  • L1B Visa -> H1B Process

    Hello,

    I am working for my company on L1B visa valid till 2018 and I have a H1B approved petition from the same company, also valid till 2018. I am planning to get my visa transferred to H1B during next year i.e. 2017. I have certain questions I would like to ask:

    - what if I convert to H1B just before petition expiration? What would be the validity of my Visa?
    - would this be considered as a COS (Change of Status) process or would there be a separate category for this kind of case.
    - do I need to make this move before the month of October?
    - would I have to go back to India to get my visa stamped or my status would change and whenever I visit India I would have to get it stamped.
    - if I have to travel to India, to get it stamped does my wife needs to travel as well or she would automatically change from L2 to H4 and the next time she visits India she can get H4 stamping.

    Probably these are basic questions but I need these details to plan accordingly as soon as possible.

      A Change Of Status can be applied at any time. Your spouse and dependent would also have to go through the COS, it will not happen automatically. You need not travel outside US for that.
