  • L1B to L1A COS rejected. after an year applying for L1A

    Hello Folks,

I have been a big fan of this forum and I believe that I would be able to get good guidance.

First time I went to US in Sep 2011 and stayed there till Feb 2016 ( In between personal travel and I got extended I94)

In Aug 2014, My employer filed for COS L1B to L1a. After RFE, I got a decision in Jan'15 denying the COS. after consulting with my company's attorney, I was advised that I can stay in US as long as my I94 is valid. While reviewing COS, the reason of COS rejection as per my knowledge was - My role was mentioned as Project Leader although I was having 2 level org structure.(this is my assessment, could be wrong)

After completing I94 tenure, I traveled back to India. Working as a Project Manager in India. Here I have 2 direct reportee and 5 indirect reportee.

My employer wants to file for L1A. Here are my questions to get better prepared -

    1. Rejection of COS L1B to L1A may have any adverse effect in my new L1A Blanket visa?
    2. What are the factors I should focus to further strengthen my case?
    3. Number of direct reportee and indirect reportee are well sufficient or should be more in terms of numbers.
    4. Critical qualification criteria being measure by USCIS for L1A

    Another tricky aspect to this-
While leaving from US in Feb'16, my employer also initiated my GC request under EB2 category. I am sure it would have not reached anywhere yet. but is there any factor I should be aware of while considering L1A visa
