  • L1/L2 Extension (Consulate or within US)

    Hi,

My I-94 is expiring on 12 June 2017 and L1B Visa is expiring on 31st July 2017. My company has an indefinite blanket petition approval. My wife has a L2 visa which is also expiring on the same date.
I have some questions regarding my L1 and my wife's L2 extension process.

    1) If I need to travel to India can I get L1 extension while taking the interview in the embassy? Do I need to get I-129S approved before I go for the interview? I remember last time when I went for L1 it was the emassy who approved my I-129S and then they only gave me the visa for me and my wife.

    2) If I am in India, do I still need to apply for her extension through I-539 form or just fill DS-160 and goto the embassy together and they will give the extension to both?

    3) Is this statement correct? If I am in USA at that time, then I will need to get I-129S approved and I-539 for my wife to get the extension?

I am a little confused that if I have to goto consulate outside USA then do I still need to fill I-535 form for my wife or I can skip that and just book the appointment with DS-160 and get the visa along with extension?

    Thanks,

          1. You need a new I129S first in order to get a visa beyond 31st July 2017.
          2. DS-160. She is eligible for dropbox.
          3. Yes. Its I129 filing in US.

Within US for L1 extension I129 needs to be filed, for L2 I539 needs to be filed. Outside US, for L1 Blanket, I129S needs to be carried along with the filled up DS-160 and L2 also has to fill a separate DS-160 online.
This is my opinion not legal advice.
