Hi there...

I am currently in India, working on getting my US visa.

I had applied for my H1B visa in April 2016 thru one of the consultants in US. My application got picked in the lottery and have received an approved petition (visa not yet stamped). But now my current employer in India is planning to apply for a L1A visa for me. I have a few questions around the same.

Can I apply for a L1 visa thru my current employer in this senario ?
Will I have to notify my current employer / USCIS regarding my existing H1 petition? (I would not prefer to do that)
Would having a H1 approved petition affect my chances of my L1 approval ?

Any insights around this would be helpful.

Depends on your employer.

Most of the companies get these info on your immigration history before proceeding this. Also in DS160 you might need to declare that as well.

Both visa category are different however that should not conflict the information you have been given.

For Example H1B application says that you are expert in XYZ and in L1A you are saying something else.
