  • What happens to my L2 when my husband (L1) gets the green card?

    Hi all!
I am now here with my husband (L1) and I have a VISA L2 (Expiration date 12/08/2019), and a valid EAD (Expiration date 03/20/2017).
What will happen to my Status while my husband waits for his AOD or when his Green Card is approved? Can I renew my EAD in March? After my husband receives the confirmation of his AOS, what will happen to my L2 VISA?
    Thanks,
    Valeria

When he becomes a permanent resident (i.e. when his AOS is approved), your L2 status will be lost. Why aren't you doing AOS too?

This is my personal opinion and is not to be construed as legal advice.

I thought it would have been easier to ask for a AOS after my husband green card. The legal office with whom my husband is working didn't say anything about this.
Don't I have a time window during which I can stay with my L2, while I wait for my AOS?

You can stay for as long as your AOS is pending, regardless of whether you have status or not.

          Thank you newacct!
Do you know if I can also work with my EAD while my AOS is pending?

You can apply for EAD for free with AOS. It takes about 90 days to get. So if your L2 status doesn't get lost until after that, you will have continuous work authorization.

You should be going through the AOS process with your spouse. Per my knowledge once his status changes from an L1 to a green card holder, then your L2 wouldn't exist anymore since it's based on the L1 which no longer exists.

                Thanks for your answers.
I'll try to file the AOS together with my husband then!
