L2 to H1B conversion

Hi,

I am on L2 currently and working on L2 EAD, I want to change my status from L2 to H1B and my employer is ready to file that however wanted to know will it fall under lottery or not ?

All cap subject H1 petitions have to go through the lottery, if at all there is a lottery, you being on L2 does not matter.
