  • Passport Renewal and USA Visa

    Hi

    We are in US on L2 visa, my kids passports are expiring in July 2017 we have USA visa till 2021 stamped

    How should go about this passport renewal?

    1) Apply for passport renewal in Indian Embassy in US?
    2) And then USIS for restamping of visa's on my kids passport?

    I would really appreciate if anyone replies with detailed procedure for this, document requirements etc..

    I absolutely have no clue...

    Please help

    Visa is not tied to the passport expiry. What it means is that even if you get a new passport, the visa in the old passport is still valid till the visa's expiry/cancellation.

    If you are not wanting to renew the passport in India you can go ahead and get passport renewed through Indian embassy in US.

    One thing you need to take care is the I94 expiry of your kids. If the I94 is also expiring in July 2017, you need to first get the passport renewed and then get the I94 extended/extension applied before July 2017.

      2. US visas are only for entering the US, and are irrelevant when inside the US. If you do not need to enter the US, you do not need a visa. That's why US visas can only be gotten at a US consulate outside the US. The US visa on the old passport remains valid even when the passport is expired, and can be used in conjunction with a new passport from the same country to enter the US.

      What determines your ability to stay in the US is your status, and how long that lasts is given on your I-94. Since their passports are expiring soon, their I-94 admission period probably ends at the passport expiry. As such, before their I-94 expires, they will need to either leave the US and re-enter (on new passport, with L2 visa on old passport), or apply for Extension of Status within the US.

        Their I 94 is valid till the 2019 ( Admit Until date is 1/17/2019) which is same as per the I 797 approval of my husband.. so i guess just passport renewal from Indian Embassy should solve the issue right?
