H1 out of Cap for L1B Extension and Approved 140

I will be completing 5 years on my L1B this October and my 140 is approved. Am I eligible for applying for Out of CAP H1 this year in 2017 ?

What are my options for continuous stay in the US beyond the 5 years through L1B.

You need to apply in cap and go through the regular process of H1 like any other cap subject petition. You can be cap exempt only if you were cap counted in the past. Being on L1 or having an i140 approved does not make you cap exempt.
