  • change b1 to l2 - just married in the US?

    Hi Everyone,

To give you a brief background my fiance was given the opportunity to do an inter company transfer to Houston and last November we flew here to check it out and find our bearings whilst his visa was in process. He returned to London last week to get his visa L1 - all approved wohoo - and now he is back in the states and as we are committing to being here I will now apply for my change of status - B1/b2 to L2 - using the I-539 form.

    My questions are -

We are going to get married in Houston, privately and alone with no family members (we have a wedding booked in Scotland 1 year from now and did not want to upset our parents) - will this be an issue with my application do you think?

My current B2 visa expires on April 29th 2017 - what do I do if my I-539 is still in process when this expires?

Do they take my passport? If so how many blank pages do I need?

Can I take a trip out of the US during the process of my I-539?

What is the average time it takes to change the status?

And any other experiences with this would be super helpful!

    Thank you guys

You can stay in the US as long as I-539 is pending

The application will be abandoned, as there is no longer any status to change. Regardless of whether you leave while it is pending or after it is approved, you will need to get an L-2 visa before you can re-enter the US in L-2 status.
