    Hi,

    I am having a valid US Visa & I-94 and I want to extend my daughter's I-94 expiry date. She is also having a valid US VISA.

    When I arrived in US with my family, the US Custom Office gave my daughter's I-94 admit date as per her Passport expiry date.

    Now I had re-issued her passport and want to extend her I-94 in order to match mine I-94 validity.

    Her I-94 is going to expire in 30 Days.

    So I want to know,

    1) If there is any possibility that I can apply for her I-94 Extension within 30 days’ period.

    2) If yes, what are the document that I need to provide to US Immigration Office?

    3) How long it takes to receive the updated I-94?

    4) Is it ok to stay in US, if the I-94 extension process take time beyond the Current I-94 Expiry date.

    There are three ways to get an updated I-94 for your daughter.
    a. Go to nearest CBP office and request for an extension. Take your passport, I129s, I797, I-94, latest paystubs and your daughter's passport, new and old, and ask if they would extend her I-94.
    b. File form I539 with USCIS.
    c. Your daughter leaves US and re enters with new and old passport and get a new I-94 at the POE.

    Your questions pretty much are relevant if you want to use option b.

    1. Yes you can.
    2. Copy of your I129S, I797, I-94, latest paystubs, your visa copy, copy of your daughter's latest and old passport (first and last pages), her visa copy.A cover letter explaining the circumstances. Filled up form I539 and the relevant check fees for USCIS(I think it is $190 USD - check USCIS website for latest cost).
    3. 2-4 Months.
    4. Yes, as long as the extension is filed before her current I-94 expires. Avoid last moment filing and keep a buffer of few extra days to account for postal delays, if any.
