  • L-1A Extension / GC in Process

Hi everyone - I'm presently working on a L-1A visa which is due to expire on July 2. My employer filed my green card application on 4/21 along with Adjustment of Status, Advance Parole etc. They are suggesting I should apply for an extension from a consulate outside the US. I have few questions relating to the process:

    1. Should I apply for an extension from India or may be from a consulate somewhere closer to the US. For instance like Canada, one of the Caribbean islands etc. We were planning to travel to India anyways in early July.
    2. Is it recommended to apply for the visa prior to the actual expiry date or it can be delayed by few days. Of course I'll travel outside the US before the actual expiry date.
    3. If I do file in India, will it be in Chennai?
    4. Should my family also travel to Chennai (wife and 5 year old son)?
    6. Can I travel outside the US in the interim period (like between today and leaving for visa extension).
    7. Are there any issues in L-1A extension? I work for a big consulting firm and have been in managerial capacity since several years.

    Thanks a lot.

You can apply from a consulate closer. A lot of people use Canada. Remember that you may need a visa to travel to Canada. You must renew it before the expiration date - check your I-94. For the visa renewal, your family must be with you as you will also renew their L2 since this is connected to your L1A. Even your child being under 14 and not requiring interview, he must be in Canada (or other country). Usually the L1A process is very straight forward. You just have to explain you are a Manager/Executive now and also before getting the visa. If you meet the criteria, just provide the answers to the questions and you should be OK.
