  • unused H1B approved petition, L1A visa

    Need some guidance on my L1A/H1B..

    I traveled to US on L1A last year,when I traveled I was also holding H1B approved petition (Not stamped) for Same employer but different project and location..
    H1B petition has a different project /location than my existing L1A Visa on which I traveled..
    My organization is planning to send all L1A visa holders back from US to India..
    Have few queries on the L1a Visa and H1B approved petition I hold.
    1. Can I get my L1A converted to the H1B while in US?
    2. Can I get my H1B Amended to use it for my current project /location or it's better to try to join the same project/location what was mentioned in my H1B petition?

    Your current status is L-1 , Since you are holding H-1B approved not stamped, You have get your H-1B stamped and come back to US . you cannot file H-1B amendment on your sutivation because you are not on H-1B Status in US for extension of stay. if you location and project are changed from H-1B approved petition. then you have file amendment before going for stamping. In both way you have get your H-1B stamped . This is just opinion not legal advice
