  • L1 visa holder, can i work with a other companie

    hi,

    i have a L1 visa, and the company where i've been dispatch for, propose me a job.
    the problem is the visa season for H1B is now over until next year 2018, and there would like me to start end of september this year.

    what can i do? can i work in usa with L1 visa for the new companie? or can i apply for greencard?

    While on L1, you can work only for your L1 sponsoring employer. Green card is a possibility depending upon the category it is filed in and your country of birth.

      There is no option for you. You cannot work for another company while on L1 visa, only for your current sponsor. Your visa has their name on it. How do you believe you can apply for a GC? Are you considering National Interest Waiver? Are you married with USC? That are the only options for you to self-apply. The company sponsoring your visa is the one that must request a GC for you. Do you really believe they will sponsor you, knowing you will leave? And, on top of everything, even if you apply for a GC today, you are not going to receive it in September. You can only change jobs after 180 days.

      So, if you have plans to stay in US, continue to work for the company that brought you in until they sponsor you. In the future, you can consider to apply for H visa in case there is a much - way much - better offer. With L1 you can have some priorities to get a GC that you are not going to have with H if you meet criteria for First Preference.
