  • L1A approved for 1 year. Can I apply for GC?

    I was told that unless L1A is approved for 3 years, one cannot apply for employment based GC?
    My L1A is approved for 1 year. I was hoping to apply for GC immediately.
    Any musing on this appreciated.

    There is no such rule. You (actually your employer) can apply for an employment based visa, even if you are not employed by them currently, or do not have a visa status at all.

      No requirement. They can even ask your GC before getting the L1A visa. They just don`t do it because not every employee (family) will adjust to US and some may leave after few weeks/months.

      Sharing my own case, my GC was filled 3 months after getting my L1A. However, internal company procedure says 1 year but I have been working with them for 12 yrs.
