Hello everyone,
New to this forum but did some searching and couldn’t find questions that may have helped me – please forgive if there are threads.
Background:
My companies American office is going to offer me a position and apply for L1 visa but I also have the option in October of applying for E3 visa under the 12 years specialist knowledge (not 4 year degree requirement).
I’m married with one child under 21 but due to my families situation they will not be moving to America with me upon successful visa application.
Questions;
Under either the L1 or E3 visa path, do my wife and child still need to apply – I believe so for L1 but E3 you need to show ties to home country so maybe they don’t?
If they do need to apply regardless but don’t come over initially with me are my documents for immigration on arrival separate from theirs? Does this cause wife and child problems if they enter later on?
What is the time limit for them to enter before their visas are no longer valid, I believe after entry and processing they can just return home and their visas are valid as long as they return to America within a certain time?
Finally and I understand it’s always a personal choice but – under my circumstances would I be better off doing L1 visa or E3 visa?
