  • L1 B VISA Query

    Hello Team,

    I recently had my L1 B VISA stamped from London, UK and planning to head back to US next month. I am an employee of Company A and my Client is company B.
    My Client Company B wants to hire me, So what are my options ?

    1. I know i can not switch on L1 B, but filing a Green Card would help in my Job switch ?

    Appreciate your help!

    A lot depends upon the category of Permanent Visa (EB1/EB2/EB3) as well as your country of birth. Merely having GC filed doesn't get you validity to work.

      I am Indian. I have a follow up question's:

      1. One of my colleague (Indian) had the same situation as mine only difference was he had L1A and he got hired by same client as i am working for.. In this case, did my employer would have filed the GC or Client did ? (He is an employee of Company B now)

      2. L1B GC in EB1 - I came back to UK from US last year July and have completed more then 1 year. Does this help in filing GC in EB1 category ?

      3. Who has to file the GC in my case ? my company or my client who wants to hire me ?

        1. Any employer can file for your GC. But only an employer for which you have worked for at least 1 Year outside US in a managerial/executive position can file an EB1 for you.
        2. If you have been performing qualified managerial/executive functions, yes, you may qualify for EB1 but as I said, only your employer can file for EB1 not the client.
        3. If you indeed qualify for EB1, then best option would be to get GC filed with your employer and once you get GC move to the client.

          This is very helpful...please let me know the cost for filing GC in EB1 category (total cost)?

            It depends on the immigration firm your employer is going to use. Please check with them.

              As Raghvi mentioned above, it is dependent on the law firm/attorneys used by your employer. Having said that, just as an estimate a value of 10k can be used, which would be correct on an order of magnitude scale.
