  • Blanket L-1 B denied- Not clearly approvable stamp on I-129S, given blue color 221G

My L-1B got denied by the Chennai Consulate in Aug 2017 and I was handed over the blue color 221(g) form with the following reason: Your Blanket L-1 application is not clearly approvable under section 8 CFR 214.2 (I) (ii) (B),(C) or (D) or INA 101(a),(15) (L).

When I check the status online on ceac.State.gov, it shows as Administrative Processing. Does this mean that there is any remote chance that the Consulate may approve my L1-B visa? Or it is just a matter of time that the status will get updated on the website to denied or refused? If so, then is it okay to apply in L1 individual category immediately?

Thanks in advance for your time and guidance.

You should not wait for the online status change. Have your employer file L1 Individual.

This is my opinion not legal advice.

Thank you for your response Raghvi!
However, my visa attorney has advised to go for L2 (along with AED) as the next best option. (my husband is on L1-B in the USA currently)

I am just worried will it create any problem uf the Consulate thinks why did my employer not file L1 for me individually and instead opted for L2 as second best option.

      Thanks in advance!

I think the only good reason your employer may have is to get your L2 done quickly. L1 individual may take 1 to 6 months.

Personally, having L1 for yourself is much more beneficial.

Yes, agree that L1 would have been a better option than L2. But I am just nervous about my L2 now as the Consulate may ask me why did i not go for L1 individual.
Now that i already have a job offer in hand (for which i had applied in L1 blanket), do i still qualify as L2 dependent. Can you accept a job offer without having a work permit?

Im just nervous if my L2 gets denied on such technical grounds. Please advise.

          Thank you.
