L1 B reaching maxout date. Any alternate options to extend my status?

  • L1 B reaching maxout date. Any alternate options to extend my status?

    Hi All,

    I have been working in the US for close to 5 years on L1 visa.
    First 3 years, I had L1 Blanket and later I got L1B- Individual and both have separate petition.
    Currently I have L1B - Individual visa, with a expiry date of 21-Apr-2021 but the petition is expiring on 10-Feb-2018. This petition expiry date is close to L1B maxout date ( If I add all the days I stayed on work visa).
    Question here is that if there is a possibility of extending my current petition? If not, what is the use of visa having later expiry date than petition?
    Is L1 B max out an hard stop and I cannot further work unless I take 1 year break? What are the other options I have with respect to work visa.

    Here are some key dates:
    First L1 B: 21-Apr-2011 to 05-Apr-2014 (PED also same)
    Current L1 B Individual: 28-Apr-2016 to 25-Apr-2021 (PED is 10-Feb-2018)

    Didn't my L1B visa clock reset when I got second petition?

    I am in the same boat. My company asked me to leave country after my max out date. Of course after PED date, my max out is after 2 months so I am applying for L1B ext until Max out. Even if USCIS doesnt give their response until Max out, I cant stay n work after max out. You may want to get expert opinion but this is what it is based on my knowledge.
