  • L1 via company acquiring my company.

    Good morning,

I am a consultant who helps companies raise finance in the USA, but I am a UK citizen and live in the UK. (I travel to the US a lot as you can imagine).

One client has asked me to move to the US and work for them permanently. They are a small US public company with a turnover of around $20m.

My (our) thinking was that they could acquire my UK Consultancy Company (it is a Limited Company (i.e., an 'Inc') registered in March 2014 with UK authorities, but obviously only I work for it). Then after a year (given the rules are I would have to have worked for the US company subsidiary for at least one year), we could apply for an L1.

    So couple of questions:

    1) Would I have to wait a year or does the fact I have worked for the UK company (my consultancy company) for 4 years count straight away as a years employment?
    2) Is my UK company too small to count or would this be a neat way of meeting the immigration visas rules?
    3) Who would be the best 'specialist' in this area from your experience to assist in the process (any recommendations).

Thanks in advance for any words of wisdom!

    Dave.
