    I hold L1A visa and currently company is in the merger process. So a lay off is a possibility for anyone.

    If that happens, my plan is first to convert my status to B2 then find a job and file for H1. Is there any other practical alternative..

    My question is that between the lay-off date and I539 change of status application there will be couple of days gap. Since I would loose the L1 status at the time of lay-off I may not be eligible to change L1 status to B2. Other possibility is that since lay-off is out of my control USCIS may ignore the small gap and process my petition. What is the important date, postmark date of the petition or USCIS receipt date (almost a week later)

    How does USCIS react in similar cases ? anyone experienced a similar situation?
    Any advice and help is greatly appreciated.
