EAD renewal while L1, L2 Extension in progress

    Hi Anjali,

    You should send in a copy of your and your husband's current I-94 as well. However, that would just be a supporting documentation. USCIS will be aware that your current I-94 is expiring in May 2018 and that you are applying for renewal. The renewal will be based on your extended L2 only. USCIS will not process your EAD renewal based on your current expiring I-94.

      Hello Rajesh/Anjani,

      I am in similar situation. My Visa & EAD is going expire on 08/06. My Spouse employer filed L1/L2 Extension and have the recipient notice. Considering with current EAD timeline want to apply EAD extension at earliest to avoid break.

      What need to be filled in i-756 Q-14 for i-94? old I-94 (expire on 08/06) or should be left blank.

        Whatever is the current I94 number will need to be included in Q14. Do not leave that blank, since you currently have an I-94.

          If i give current i-94 (expiry in 08/06), they can be possibility of giving an EAD till right 08/06. i read in some online help forms, while approving the EAD they always give it till i-94 is valid which was mentioned in the i-765 form.

            You will be mentioning on I-765 that this is for your EAD Renewal. So there is no chance (unless a clerical error or a gross oversight) that your renewed EAD will be till 08/06. Your renewed EAD will/should match the L2 Extension I-94 date.

            They already know based on your history that your current EAD is valid till 08/06.

                About EAD renewal application

                Hi Rajesh,

                I have a question on EAD renewal application. I applied for EAD extension when we got our L1/L2 extension receipt number with receipt number and other documents. Now, my question is, if I get L1/L2 visa approval soon, can I submit them based on EAD receipt number that I got recently? Or I have to wait to get RFE on it to send visa approval documents?

                  Hello Sandhya,

                  Even if you get L1/L2 extensions approved, do not send any additional information to USCIS - unless explicitly asked for. It will be requested via an RFE (happened to me).

                    Hello Rajesh,

                    I am on L1 visa and by virtue of that my spouse is working on L2 EAD visa and our visa is getting expired in couple of months.
                    Can my spouse file EAD based on I-539 receipt and leave for the home country while the processing is in progress.
                    In case she receives a RFE which she will as we have not submitted an approved petition, can I send the relevant documents on her behalf to USCIS or she need to be physically present in US for responding to that.

                      Hello Shankha,

                      While it is generally not seen as an issue when an L2 visa holder first applies for a new EAD and then leaves the country while it takes a few months to get the new EAD processed and approved, it is NOT recommended that while the L2 I-94 is getting extended (via I-539) that you leave the country. This may lead to complications in approval of the L2 Extension and thereby issues in approval of the EAD renewal.

                      Better to stay in the US when L1/L2 Extensions and L2 EAD Renewals are in progress with the USCIS. If there are extenuating circumstances, please contact an attorney for legal solutions.

                        EAD Renewal after current EAD expiry

                        HI,
                        I am in a similar situation, but my spouse's L2 EAD has already expired. Here is the situation
                        1. My L1-A Renewal (I-129) submitted on 05/16, got an RFE
                        2. My Spouse's L2 Renewal (I-539) Received at the center on 05/16
                        3. My Visa ,spouse's L2 & EAD expired on 08/25
                        4. My L1-A RFE response was accepted and I-129 is approved on 08/30

                        Now How do I renew my Spouse's EAD? Is it possible to renew it now or we will have to wait. Could someone help here please?

                          Can someone advise on this at the earliest,

                          L1A petition expiring in Jan 2019, I 94 - Jan 2019
                          Spouse i94 Expiring Dec - 2019 - EAD expiring on Jan 2019.

                          MyL1 petition extension is in progress and yet to receive the receipt number.

                          Please let me know if I can file the renewal of My spouse EAD as her i94 is valid till December.

                          Also, share the list of document that I need to file a renewal

                            Hi All,

                            I am in the similar situation where my EAD is expiring on 1/3/19 and my application was received by USCIS on 09/19 as per https://egov.uscis.gov/casestatus and on 10/10 as per https://my.uscis.gov. Confused why are they different? The second link was provided to me by the users on other forums. Looking at the receipt number starting with WAC, I see the application is directed to CA service center and they process very slow.

                            My questions-
                            1) why is that difference in application received date?
                            2) I read in other forums and also on USCIS website that EAD gets renewed if applied on time before the expiry. Does it apply for everyone or only for specific categories?

                              L1-L2 EAD renewal in Canada or home country?

                              Hello Rajesh,

                              My husband just got his L1 extension blanket petition filed and now I am confused how to go about my L2 extension and EAD renewal done. Last year I lost my job as USCIS took 4 months to renew my EAD (I had sent my renewal application 60 days prior to expiry but it took longer for the to process it and in this long wait time my EAD was expired).
                              I had sent my EAD renewal request in July2018 which went to the Vermont Office(USCIS). They took 4 months to send me my renewed card and that also with a validity of only 5 months only since my husband's L1 is expiring in Apr2019.
                              Now when this L1 is getting extended its time again for me to renew my EAD once again. I want to send my L2 extension and EAD renewal together this time to the CA office.
                              1. Is it safe for us to get the L1 extension stamped only for my husband in Canada or home country (India) is a better bet?
                              2. Should my L2 stamping and EAD renewal be sent together to CA office hoping they will work sooner than the Vermont Center(their current I-765 processing time is 4months-6months)?I am
                              worried as I do not want to wait for 3-4 months for my EAD renewal. I am unemployed due to this confusion on the processing time. Even though I get a job now I might have to get it
                              terminated if it takes longer than April 2019 (my EAD is valid till Apr 2019)
                              2. Does the L2 extension and EAD renewal start only after L1 gets stamped? or is there a faster way to file it? As the process takes so long! Despite of my every effort to expedite the renewal
                              they did not expedite it and rejected all my requests.

                                I may not answer all your questions but can share my experience atleast. 60 days is not longer time, If you get your renewal approved in 60 days you are just that lucky. I think you can apply about 120 days prior to expiry and 3 Months is average processing time. And mine is just approved today with California and they took about 100 days. And I don't think you can send it to any office as you wish to CA insead of Vermont. We have to send the applications as per the geographical area and from their the applications are distributed to the service centers.

                                I am also in similar situation as you are now. L1 expiring in June not yet filed for renewal. Have to see the expiry of EAD once received the card on hand. What I heard from other forums atleast is apply for extension atleast 3 months ahead of expiry, doesn't matter whether your L1 is approved or not. You may get RFE after 45 days of waiting and then you can respond with the L1 approval.

                                Wondering why L2 extension was not filed with L1 petition.
