EAD renewal while L1, L2 Extension in progress

Hi All,

Does anyone know if EAD is expiring before L1/L2 extension which is 6 months down the line and if I renew the EAD today, what will be the End date? Will it be last date of visa before extension and do I need to apply EAD twice in span of 6 months in this weird situation?

I am on L2 and my VISA & EAD is expiring on Oct 25,2019. My wife's company is about to file for Next 2 Year L1B VISA Extension.

-Can i apply for EAD renewal after getting L1B VISA extension receipt number?

- If yes , what are the documents require for it?

And is there anyone with same status like us?

Hi Deepak,

Sorry I could not write earlier. You probably have already filed your EAD renewal but yes, you can apply for renewal based on the filing of the L1 and L2 extensions and including the receipt number in a cover letter for easy reference to the USCIS. Please follow the thread as I have previously listed all the documents I submitted to get my wife's L2 EAD renewed.

My spouse L2 EAD end date is 05/20 having I-94 end date as 07/20. My employer advised me to file a new L1 Blanket visa from Canada. Can you please help me clarify below queries.


-- Can I apply for L2 EAD renewal before getting my L1 Blanket visa approved in Canada ? If yes, then for EAD renewal will the I-94 and I-797 (having end date as 07/20) can be submitted ?
-- Once L1 Visa gets approved, USCIS will take up the L2 EAD for renewal ?

Hi Tej,

Per USCIS instructions, we also sent a copy of that portion of the document to aid in renewal of the EAD. The USCIS probably requests this to tie/link your initial EAD to the renewed one to speed up the processing of the renewed EAD (beyond this reasoning, I don't know what else could this be used for).

Here is what I sent for my spouse (EAD Holder) .....

• Filing fee for Form I-765 of $410 via personal check payable to U.S. Department of Homeland Security.
• Form G-1145, Request for e-Notification
• Form I-765, Application for Employment Authorization
• Copy of current EAD Card
• Copy of USCIS Mailer with the current EAD Card and Receipt information
• Copy of current I-94
• Copy of Passport with valid visa
• Copy of Form I-797C indicating Receipt Number (WACxxx) of Form I-539 (Application to Extend/Change Nonimmigrant Status)
• Copy of Form I-539 (Application to Extend/Change Nonimmigrant Status)
• Copy of Approval Notice Form I-797 for Form I-765 (Application for Employment Authorization) for current EAD; Receipt Number (LINxxx)
• 2 Photographs

and me (Principal L1 Holder) ....

• Copy of Spouse (Principal L1A Applicant) Form I-797C indicating Receipt Number (WACxxx) of Form I-129 (Petition for a Nonimmigrant Worker)
• Copy of Spouse (Principal L1A Applicant) Form I-129 (Petition for a Nonimmigrant Worker)
• Copy of Spouse (Principal L1A Applicant) Passport with valid visa
• Copy of Spouse (Principal L1A Applicant) current I-94
• Copy of Marriage Certificate

Hi,
i sent my EAD renewal form along with my husband's L1 a premium processing request (I 907).

My husband received his receipt whereas I haven't received my receipt. It's been more than 30 days and also my cheque hasn't been cashed.

How can I find out what's happening with my EAD request?
I have called up USCIS and it's been of no help.

Namshe. - You have not mentioned, but I will assume you have you sent your L2 extension form and L2 EAD extension forms together with the L1A
The premium processing is applicable ONLY for L1A and NOT for L2 and L2 EAD.
As per rules that changed (in 2019 IIUC), the L2 extension processing is a separate processing. Earlier, there was courtesy processing of L2 extension along with L1 extension but now it is disjoint. The disjoint-processing started because L2 extension processing now requires biometrics to be submitted. There is most likely a huge backlog on biometrics appointments (all the more increased by the pandemic).

Of course, the L2 extension will be disapproved if L1A extension gets disapproved but you have crossed that barrier.
So, as next steps :
1) You need to wait for L2 extension to be processed and expect a biometrics appointment as the next step for that. As per USCIS website, for California Service Center, the current processing time for L2 extension is 12 - 15.5 months (yes, you read it right, 1 year or more).
2) Once L2 extension is processed, the L2 EAD will be processed.

Hi,

My wife applied for EAD form -i765 in 2020 and received receipt notice on 11th March 2020. At the time of application I had approved 1-797A and she was waiting for extension so, EAD application was sent with my L1-A - approved petition and her I-797C receipt notice. Her L2- extension got approved in March and now we want to send the approval notice to USCIS.
Our case is in California Service center- Do i need to send the L2-approval notice to California service center or to the Skyharbour Phoniex AZ office?

USCIS will send you a RFE if they need additional information, otherwise you should not be sending unsolicited documents just because you have something you think USCIS needs to process the application further. It will most likely be discarded.
The address for submission of additional documents will be found, most likely, on the RFE document (once you receive it). If not, it should be the address on your I-797C Notice of Action.
You can probably check the case status to see if a RFE has been issued.

1. How much time did it take for your L2 extension after L1 got approved?
2. How much time did it take for EAD to arrive ( hope you got it )?

Thanks arajesh19 for the information. I am also planning to file my EAD renewal immediately after receiving receipt numbers for L1B and L2 extension filing. On some forum I read that USCIS ask you for information on approval of your visa extension. It didn't make much sense to me. I believe they should have information if the person's visa extension is approved or not. My question is- Do they ask for additional information on approval of visa extension or do they check with their system to get that information?
