  • Question About L1-B New Office Extension

    Hi. I'm trying to lay some ground work before proceeding to work with an attorney.

    I work for a manufacturer company doing trade with 70+ countries including US. Now they want to open a subsidiary in US and send me to develop the market and introduce products. In this scenario, I would be getting an L1-B visa for one year for the new office.

    This is the tricky part. They are not thinking about hiring another personnel within the first year. But we will be conducting business for sure. (Importing goods, selling, paying taxes etc.)

    My question is, me being the only employee after the first year, is it certain that my extension request would be denied?
    Would it be possible to get the initial L1 if I state in the business plan that we are not planning to hire personnel for the first year. (I'm sure we would be hiring after second or third year)
    Instead of hiring new personnel, can the company be working with contractors, consultants etc. Me being the only sole worker and still get L1-B extension.

    I did some deep research but not sure about this issue. Thanks in advance for your kind help.

    Slightly depends on which country are you from. But largely you won't have any problem in extension, as company's performance can vary & based on that the decisions to hire one or more can change.

    At the time of renewal your company can mention that they did not get much success so far, hence planning to extend you for another year or two & will hire new people if needed. Your company should be able to provide documentary evidence for the same.

      Libra! I appreciate your input. It's great to hear that. I can go ahead and start the process with an attorney. For the record, my head company is located in Turkey.
