  • Applying for an L2 EAD from abroad

    Hi guys!

    I am an L2 holder, currently trying to apply for an EAD but I have one constraint - I live and work in Europe.
    In order to minimize the trips made to the US until I have my EAD, I am now laying out the milestones where I absolutely have to be in the U.S.

    Here's what I have for now:
    - I have to be in the U.S. to file for the EAD (due to the I-94);
    - I have to be in the U.S. for the biometrics appointment;

    Can some of you help me out clarifying the following:
    - Are there any other milestones where I absolutely have to be in the U.S.?
    - It seems that the biometrics are not mandatory for some people - does anyone know the exact criteria for this?
    - Does anyone have any tips for me during this process?

    Thank you so much,
    Manuel

    Yes, certain categories of L2 EAD donot require biometrics, eg. Mine is A18 and I dont have biometrics. May be your attorney can confirm which category you will file under and advise on biometric.

    Other than your visit to USA for I94, there is no other requirement for you to be physically present while the EAD is under process, except for may be if there is an RFE (request for evidence) for any additional supporting documents.

    This is my opinion and not a legal advice. Thanks.
