L1/L2A W-8BEN Forms. Do we need to fill these out?

My wife is here on a L1 visa and when we opened our first bank account the bank fraudulently filed for credit on our behalf. Once we learned of this, we changed banks immediately. We closed all accounts with them and moved to a new bank. This bank never had our SSN or Tax ID.

We are now getting letters every week to fill out a W-8BEN form from the previous bank threatening IRS action. The new bank has never given us a W8-BEN form and does not know why we would need one.

I am bit confused by what I find online. We are from Canada and have a tax treaty with the USA, but live here full time and pay taxes here full time.
