  • L2 dependent Visa - employment status

    Hi

I am currently preparing my application for the L1A blanket Visa, and am planning to take appointment for my wife and kid alongside my own interview.
I plan to travel to the US in July/August (if the Visa comes through) but wife and kid would join only by end of year.

My wife works currently but since she is not planning to quit till end of year, she does not wish to inform her employer about applying for this Visa.

While filling the DS 160 form for my wife, we came across the employment information section. If we select employed option, would she need to get an NOC from her employer before going for the interview? She cannot do that as they might then find a way to terminate/suspend her employment out of spite.

Alternative is to fill 'Homemaker' in the employment history section in DS 160, but wouldn't that be illegal and wrong?

Has anyone faced a similar issue? Thanks for your help!

My husband and I applied for an L1 and L2 visa. I was applying for the L2 and was the director of the small company I owned and ran. They didn't contact me or my business to check if the job description I put down was correct. So I imagine the question is so they have a record of what type of employment an L2 visa holder would look for in the US. Also I don't know what your plans are for your wife to come over but you should be aware that she will need to enter the country before she can apply for her EAD. She can leave again afterwards but the process can take around 6 months at the moment so it's a good idea to get it underway if she wants to work in the US once she moves over permanently.

    I hope that helps.

No, they won't contact the employer.

However, she can say that she is keeping the visa ready, so that she can freely make multiple visits to you.
