  • Visit to US after I94 expiration

    Hi,

I was working in US under a L1 visa and returned back home some months ago as my project in US came to an end. I am planning to return back in US for 2 weeks to spend some vacation and my I94 is going to be expired during this stay. I was planning to submit then an ESTA. Due to the expiration of my I94 and the fact that I will spend my vacation in the place where I was living/working when I was in US, I am wondering what should I expect and if the authorities are not going to suspect that I am back in US for work without valid I94.

    Please advise!
    Thanks!

The I-94 is only for a particular stay. That L-1 I-94 you had no longer exists as you have already left the US. When you seek entry, you will be seeking a new stay on the Visa Waiver Program and you will receive a new I-94. You of course cannot work as a visitor, and if they suspect that you will work (not sure why they would, but if they do) they could of course deny you entry.

This is my personal opinion and is not to be construed as legal advice.
