  • Reapplying L1-B

    Hi,

    I applied for L1-B in 2005 and was granted for 1 year. I applied for extension after 1 year and was granted again for 3 years. However, I came back within 6 months to India. So overall I stayed in USA for 18 months on my L1-B

    Considering L1-B is granted maximum for 6 years, if I reapply again how long can I stay now? Is it 4.5 years (6 years - 18 months) or just 2 years (6 years - previous 4 year grant)

    Could some one clarify? Also, what is the success rate in trump administration

    I work with different company now (for past 5+ years) and have total 14 years of experience

    Since you've changed your employer, you'll need to apply for a new L1B & now you'll get another 6 years with the new employer.

    Or, you can also claim for the remaining 4.5 years on the existing L1B, if you move back to your previous employer. Please note 6 years is not counted as the period of your visa/petition, rather it is counted on the basis of time you've spent (getting paid) in USA on the visa.

    L1B is NOT a Once in a lifetime visa. You can get multiple L1B in your lifetime with different employer & can stay in USA for 6 years with each employer - as long as your satisfy the basic requirement of the visa.

      Great, that's good point for me, since I have changed the employer I can get full term again !!
