L2 dependent Visa

Hello All,

My visa & I94 expires on 01 Nov 2018. My wife's L2 visa has been granted till the same date as mine and she is yet to travel to USA. My extension has been filed and awaiting response. can anyone please help with the below questions.

1) Can my wife travel now and apply for I94 extension for herself?
2) what would be scenario at the POE since my wife has less than 2 months of VISA?

Yes, it will be best for her to travel as soon as she can & apply for extension based on your extension application.

2) what would be scenario at the POE since my wife has less than 2 months of VISA?

Visa is merely for entry into the USA & she can enter with just one day of validity on Visa.

However her I94 will be determined based on your petition & most probably will be given the same date as your current I94.

One more thing, please ensure that she carries all your documents when she travels to USA.

For example, copy of your petition, copy of your visa & passport, your salary slip & you bank statement to prove that you are in USA & currently working.

1. Can I upgrade to premium processing for my extension?
2. Is L1B premium processing also suspended?. I know that H1B premium processing has been suspended for now.

No. Only H1B is suspended as of now.
