  • L1B (Blanket) Specialized Skill - Visa and EAD Card

    Hi,

I am on L1B Specialized skill visa. I have couple of questions :

    1) My visa on passport is getting expired on Sept 2019. and my I 129 is approved till Aug 2019. However, I have valid I-94 till May 2021. Can you please suggest that till what time I can work in USA on my existing L1B visa for the same employer?

    2) My wife is on L2 dependent visa and her EAD is getting expired on May 2019. Her visa in passport is getting expired on Sept 2019 and I 129 in Aug 2019.
However, her I 94 is valid till Dec 2020. So if I want to extend her EAD, then how long before I should start process ? and Can we apply for EAD extension as only I 94 is valid ?

    Appreciate your response on this.
    Thank you.

Your I94 defines on how long you can "stay" in USA. However your I129 or I797 defines till when can you "work" & get paid.

Since your I94 is valid till May 2021 - you can stay in USA, but in absence of a valid unexpired I129 or I797, you can not work legally.

Visa is merely used at POE for entry into USA. After that visa validity doesn't impact your ability to work/stay in USA.
You can apply for EAD renewal at the same time of your petition renewal application - response for both application will come almost at the same time.

In normal situation, you should start renewal before 4 months of expiration.
