L1B + I94 exceeds 5 years, Can I stay in USA

    Hi,

    I am on L1b and my entry date to the USA was Aug 1 2015
    My visa expiry date was Jul 25 2018
    But I got my i94 extended till Jan 20 2021, where the total duration of the stay exceeds 5 years.

    Can I stay in the USA till my i94 expiry date or it is illegal to stay more than 5 years on L1B?

    It is illegal to stay for more than 5 years - however you can claim the period you were not in states or not working/get paid. Consult your attorney though.
