  • L2 extention from india based on L1 I-94

    L1B expired Jul-2017
    I-194 valid Jan-2020 (As i traveled in Jan-2017 to 3 years)

    L2 expired Jul-2017 (same as mine)
    Now she is in India, so can we apply L2 extension from India based on my I-194

    Yes, though not based on your I94, but based on your L1 petition (visa expiry is irrelevant).

      But as L1-Petition(i-129) also expired, Jul-2014 to Jul-2017. I am staying in USA based on I-194. but my depended in India with expired visa.

        What will you do with L2 VISA extension if she is in India.

        She can't travel without valid VISA.

          Yes, to travel she need a valid visa. And for visa, she'll need a valid petition / extension.

            Yes, agree with you for travel need visa and for that need petition or extension.
            However as per my attorney i am not eligible for extension because i am already in USA and my I-94 is valid till Jan-2020. so i am good until 5 year cap.

            So question is there any way just apply L2 extension without impacting my status in USA.

              Please consult an attorney, I doubt you can "work" on an expired petition - You can stay in USA, since your I94 is not expired.

              Please provide below dates for yourself & your spouse to help you better.
              - Visa expiry date
              - Petition expiry date
              - I94 expiry date

                I consult my attorney, he said no action needed as your I-94 is valid.


                1) L1 visa : Jul-2014 to Jul-2017 expired.
                2) L1 I-94 : Jan-2017 to Jan-2020 (as i traveled to india in last jan)
                3) I-129s : from Jul-2014 to 3 years as Jul-2017 same as visa
                4) I-797 : Valid from Jun-2010 to indefinitely (company wise blanket petition)


                1) L2 visa: Jul-2014 to Jul-2017 expired.
                2) No I-94 as she is in India.

                  So you DO have a valid petition in the form of I797, hence you can work freely.

                  Ask your wife to carry I797 & apply for visa.
