L1A - approved, stamped till 6 mths future date, but employer says I overstayed

    Hi experts,

    My L1A is stamped till Apr 2019, as in I797. I made 3 reentries in last one year to US without any hassle and current I94 is valid till Apr 2019 as well.

    Now the employer says, the USCIS has made an error giving this expiration date, although my tenure is maxed out almost a year ago!

    In this case, should I have any problem remaining in US any further?

    Since you have an valid I94, you are not overstaying legally.

    However for your tenure of 7 years "working" in USA - it is calculated based on the real time you were working & get paid (you get advantage of unpaid period & PTOs).

    So 7 working years can be around 8 calendar year & its not a problem.
