  • Changing from L2 to F1 for Dependent CHILD

    Hi,

I am on L1A Visa and my son (on L2 visa) who is in high school senior year and planning to go to college here from Aug'19. My L1 is coming for extension in Oct'19. Is it a good idea to continue his status on L2 or better to change it to F1, so that he will not dependent on my Visa status and can take any campus jobs or paid internships if he gets. Will there be any problem to apply for GC (as dependent) for him in case I am applying for GC in future under EB1C?. In case F1 is better option, is it better to drop his name from my L1 extension application which may file before Aug'19 or is it okay to have both the applications submitted?. Or is it better to wait for L1 extension result and then switch to F1?

    Thanks,
    Niranjan

Thats a nice thought to keep young kids on their own separate visa.

No problem for him as well as for you.

Yes, but my suggestion would be to get your petition renewed under premium & then have him switch to F1, that way - he will have a chance to switch back to L2 at any time.
