  • L1 approved, L2 and EAD pending

My employer filed in premium processing for my L1 extension and my wife's L2 and EAD extension.
As per USCIS, the receipt dates are Dec 12, 2018.
My L1 extension is approved as of Dec 19, 2018. However, my wife's L2 and EAD extensions are still showing 'Case received'.

On calling USCIS, the agent said that it is courtesy from their end where they may decision L2 and EAD together with L1 but they are not mandated to do so.

Is there any way I can convince USCIS to approve L2 and EAD extensions for my wife at the earliest.

Any help / suggestions are welcome.

    Thanks

There is no such way, ideally if your L1 is approved, their L2 will be done soon.

On calling USCIS number, the agent said that only L1 has premium process. L2 and EAD is at agent's discretion and they are doing in regular processing in my case.

Please update once you get the L2 and EAD approved, hope its not as long as the usually processing.Else it defeats the purpose of filing together!

If you are filing L1 extension, L2 extension & EAD renewal all together, then you'll get the response of all 3 almost together.

I hope that is the case in mine.

Then the original poster of this thread "magra"'s case was an exception.

That's correct. Since they are reviewing once's case they approve everything (as to avoid reviewing the same case again for dependents & EAD).

Exceptionally, it happens that they delay dependents & their EADs.

                    Latest update:
EAD receipt number updated online today with the message 'New card is being produced' .. I guess this means EAD is approved. Does anyone know how much time it will take to receive the card in hand now?

Still no update on L2 though. However, I was more concerned on the EAD as my wife can still work on a pending L2 extension with the new EAD in hand.

I will list down the timeline of my cases for the benefit of all.

Dec 12th - L1, L2 and EAD extension received by USCIS (filed in PP concurrently)
Dec 14th - Money deducted for EAD from bank account
Dec 15th - I called USCIS service center. Told my wife's name, date of birth etc and the agent was able to give me L2 and EAD receipt numbers over phone. I had already got L1 receipt number from my employer's legal team (USCIS emails L1 receipt number to them on receipt date)
Dec 19th - USCIS online status 'approved' for L1 . My legal team also received approval email from USCIS. However, no change on L2 and EAD.
Dec 21st - Called USCIS customer service. Told them the 3 receipt numbers were filed concurrently but they said L2 and EAD are not eligible for premium and they are not obligated to decision together. They were telling me the regular processing timelines. Raised expedition requests for L2 and EAD under 'severe financial loss'.
Dec 26th - USCIS denied expedition request on L2, asks documents on EAD expedition request. We provide documents via email.
Dec 27th - Call local Congressman office for help, submit info with the office
Dec 28th - Call USCIS premium contact service centre. Agent told that due to holiday season, many agents are on leave and hence they are priotizing L1 applications right now. Will come back to L2 and EAD after holidays are over and L1 backlog is cleared
Jan 3rd - Update on EAD receipt with 'New card being produced'

                    Hope this helps.

                      Congratulations !!

You can expect the renewed card in a week or two.
