  • H1B to L1A conversion rules

    Hello Experts,

    I am in following situation and request your advise here...

    I am working with 'ZZZ' company and was in US between 2014 to 2018 December on H1B visa and relocated to India on same company and continuing with it. My company is ready to convert my H1B to L1A.

    1. If i apply for H1B to L1A now - do i eligible for 7 Years of fresh L1A or 3 years only? (deducting 4 years of H1B used)

    2. What should i do to be eligible for new L1A 7 years?

    3. I have I140 approved on my H1B - what happens to I140 once it is converted to L1A?

    4. What could be the duration i should expect to get GC if i convert EB2 to EB1

    There is no conversion from H1B to L1A. Stay in your home country for an year & then apply for fresh L1A for a 7 years.

    You can still use it with your L1A, so once you are back in USA simply apply for 485.

    Roughly (as of now) 1.5 years after you reach USA
