  • COS from L1B to F1 - Requesting Suggestions Please!!

    Hello There,

I have been trying to dig information on this topic from several threads. Unfortunately, i did not get the information i was looking for, so posting a new thread- Please suggest.

I am working for a company that sponsored L-1 B visa for me that is valid from May 2017- May 2020. I always wanted to pursue Masters in the USA so i decided to apply it now. I understand i can apply for universities while on L-1 b. However, i somehow want to pursue masters on F-1 an use OPT option to move to H-1 later. So, below are the two questions i got:

    1) If i apply masters while on L-1b, get an I20 and then travel to Canada for F-1 stamping, would that be a safe option so if my visa is rejected, i can still enter on L-1 and work for the same company?
    2) Is there a way i can apply COS from L-1B to F1 without letting my employer know and do i need to wait until the COS is approved before joining the university?

Appreciate the help here and thank you in advance.

You can continue staying in USA & just file for COS to switch to F1 & continue with your studies. No need to go anywhere for stamping & then risking everything.

You don't need to tell your employer that you are filing for COS. However the moment your COS is approved you'll loose your L1B status & won't be eligible to work.

Many thanks for the suggestions. Can i ask the expected time frame for the COS from L-1 to F-1? Is there an option to expedite like premium processing?

Processing time depends on the type of form & location:
This site provides applicants the ability to see an estimate of the time to completion from submission of USCIS forms based on its adjudication location and subtype.
