Hello,
I know someone in L-1B with an approved labor cert. EB-3 category. His employer just filed the I-140. However, because his category is EB-3 he will be pushed back. His L-1B expires next year.
What are my friend's options? Can his employer filed a change of status from L-1B to L-1A? If it can be done, will this change of status affect my friend's labor Certification/I-140 status in the future, when his visa number becomes available?
If change of status is allowed, does this means, employer will need to file a new labor cert for the new higher position my friend now performs? or no?
